Terms and conditions

Last updated: 25th September 2026

These terms govern your use of the Scotsoun Digital Archive at https://scotsoun.co.uk ("the Archive", "we", "us"). By browsing the Archive, listening to recordings or subscribing to our podcasts, you accept these terms. If you do not accept them, please do not use the Archive.

Who we are
The Archive is published by the Scots Leid Associe, a Scottish charity, number SC010286, of 47 Willowpark Court, Airdrie, ML6 0DS You can reach us at publishing@scotsoun.co.uk.

Scotsoun was founded to record and publish Scottish song, music, poetry and spoken word. The Archive makes those recordings, and the information about them, available for listening and study.

Using the Archive
You may listen to the recordings, read the accompanying material and share links to pages on the Archive. You may quote from the Archive for private study, research, criticism, review or teaching, provided you credit Scotsoun and the performers.

You may not, without our written permission:

copy, download, re-upload or redistribute recordings, except where a download is expressly offered;
use any recording or image commercially, including in advertising, broadcast, film, games or other published works;
edit, sample or remix recordings, or present them as your own;
remove or alter credits, titles or other information;
collect material from the Archive in bulk, whether by automated scraping or otherwise, or reuse it to train machine learning models.
If you would like to use material beyond this, please ask. We will usually be glad to help, and where we do not hold the necessary rights ourselves we will say so.

Rights in the recordings
The recordings, artwork, liner notes and written material in the Archive are protected by copyright and related rights. Rights are held by Scotsoun, by the performers and writers, or by their estates, as recorded on each item's page. Nothing in these terms transfers any of those rights to you.

The Archive contains historical material. Some works are still in copyright; others are published here with the permission of the rights holders. Where the rights position of an item is uncertain, we have made reasonable efforts to identify and contact the rights holders.

Rights concerns and takedown
If you hold rights in something published here, or you are a performer, contributor or a member of their family and would like an item reviewed, please contact us at publishing@scotsoun.co.uk with details of the item and your connection to it. We will respond within 14 working days, and will remove the item from public view while we look into it if you ask us to.

We also welcome corrections: much of the information in the Archive comes from original sleeve notes and may be incomplete or mistaken.

Sensitive content
The Archive preserves recordings made over several decades. Some contain language, attitudes or descriptions that were current at the time and that readers and listeners may now find offensive. They are kept as they were published, as a record of their time, and their presence here is not an endorsement.

Podcasts and other platforms
Selected collections are published as podcasts and are available through services such as Apple Podcasts and Spotify. Your use of those services is governed by their own terms and privacy policies, not by these terms. The recordings themselves remain subject to the conditions set out above.

Availability
We aim to keep the Archive available and accurate, but we provide it "as is". We may add, change, withdraw or correct material, and we may suspend the site for maintenance, without notice. We do not guarantee that the Archive will be uninterrupted or free of errors.

Links to other sites
Where we link to other websites, we do so for information only. We are not responsible for their content or their handling of your data.

Liability
To the extent permitted by law, we are not liable for any loss or damage arising from your use of, or inability to use, the Archive, or from reliance on information published here. Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

Your privacy
We collect a small amount of information about how the Archive is used, such as which pages are viewed and which recordings are played, in order to understand what people find useful and to report on the Archive's reach. We do not use advertising trackers.

Changes to these terms
We may update these terms from time to time. The date at the top shows when they were last changed, and the current version always applies.

Governing law
These terms are governed by the law of Scotland, and the Scottish courts have jurisdiction over any dispute arising from them.
